The Department of War has launched a website to guide industry partners on implementing Section 805 of the Fiscal Year 2024 National Defense Authorization Act, a measure that will limit future procurement from entities listed under Section 1260H as Chinese military companies.
Managed by the Office of the Assistant Secretary of War for Industrial Base Policy, the site consolidates information on forthcoming prohibitions and key dates. It outlines two phases: the “Entity Provision” or direct ban taking effect on June 30, 2026, and the “Goods and Services Prohibition” or indirect ban that applies to supply chains starting June 30, 2027.
The portal provides resources for companies working with the Department, including instructions for seeking a waiver. The process is intended for partners that need additional time to shift away from suppliers on the 1260H list and calls for a compelling justification along with a detailed plan to phase out affected relationships.
Industry partners can access the site at https://www.businessdefense.gov/805-waiver-request.html and direct questions to [email protected].
